BoardBound Terms of Service

These Terms of Service ("Terms") govern your use of the BoardBound mobile application ("the App"), operated by Martin Apps LLC ("we," "us," or "our"), an Alabama limited liability company. By creating an account or using the App, you agree to these Terms.

1. About the App

BoardBound is an educational exam preparation tool designed to help Family Nurse Practitioner (FNP) students prepare for the AANP and ANCC board certification exams. The App provides a question bank, spaced repetition study tools, progress tracking, and an AI-powered tutor feature.

BoardBound is not a medical device and does not provide medical advice. It is strictly an educational study aid. BoardBound is not affiliated with, endorsed by, or connected to AANPCB® or ANCC®.

2. Eligibility

You must be at least 18 years old to create an account and use the App. By using BoardBound, you represent that you meet this requirement.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You may not share your account or subscription with others.
• You may delete your account at any time in Settings. Account deletion permanently removes all your data from our servers.

4. Subscriptions and Billing

Free Tier

BoardBound offers a free tier with limited daily access to questions (30 per day) and AI Tutor interactions (3 per day).

Paid Subscriptions

• Monthly — $29.99/month, billed monthly through Apple
• 3-Month Sprint — $79.99, billed once for a 3-month period

Subscriptions are processed and billed by Apple through your App Store account. By subscribing, you also agree to Apple's Licensed Application End User License Agreement.

Renewal and Cancellation

• Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.
• No refunds are provided for partial billing periods. Refund requests must be directed to Apple.

Restore Purchases

If you reinstall the App or switch devices, you can restore your subscription using the "Restore Purchases" option in Settings or on the subscription screen.

5. AI Tutor Feature

• The AI Tutor is powered by Anthropic's Claude API and generates educational explanations based on the stored rationale provided with each question. Questions and rationales are AI-generated and machine-audited; they have not been reviewed by a licensed clinician.
• AI-generated responses are for educational purposes only and should not be used for clinical decision-making.
• You must consent to data sharing with Anthropic before using this feature. You can revoke consent at any time in Settings.
• Do not enter personal health information (PHI) or real patient data into the AI Tutor.
• AI Tutor usage is subject to daily and monthly limits as described in the App.

6. Acceptable Use

You agree not to:

• Use the App for any purpose other than personal educational exam preparation
• Copy, redistribute, or sell question content from the App
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated tools or scripts to access the App or its services
• Circumvent usage limits, rate limiting, or subscription restrictions
• Use the App to generate content for competing products or services

7. Intellectual Property

All content in the App — including questions, explanations, rationales, user interface design, and branding — is the property of Martin Apps LLC and is protected by copyright. You may not reproduce, distribute, or create derivative works from App content without our written permission.

8. Content Accuracy

We strive to ensure all questions and explanations are clinically accurate and aligned with current evidence-based guidelines. However:

• We do not guarantee that all content is error-free.
• Clinical guidelines evolve; content may not reflect the most recent updates at all times.
• You can flag questions or AI responses you believe are inaccurate using the in-app reporting feature.
• BoardBound is a study aid, not a substitute for your education program, clinical training, or professional judgment.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARTIN APPS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Using the App will result in passing any certification exam
• All content is complete or free from errors

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARTIN APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR FAILURE TO PASS A CERTIFICATION EXAM.

Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the App or email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by deleting it in Settings. Upon termination, your right to use the App ceases and your data is permanently deleted.

14. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Alabama.
